General Terms and Conditions and Privacy Policy

In order to be able to expand our offering even more in the future, but also to meet future regulatory requirements, we have revised and restructured our General Terms and Conditions (GTCs) and Privacy Policy (PP), making them simpler and easier to understand. Do third parties (for example, Mobiliar) get access to my customer and client data with this adjustment of the General Terms and Conditions (GTCs) and Privacy Policy (PP)?

No. Third parties, such as Mobiliar, do not have access to your customer or your customers' data at any time. Of course, under no circumstances will accounting data, the data of your customers and clients or other sensitive data be shared with the Mobiliar Group.

bexio has adapted and restructured its General Terms and Conditions (GTCs) and Privacy Policy (PP). What are the reasons for this?

bexio has performed very little adjustment to its General Terms and Conditions (GTCs) and Privacy Polity (PP) over recent years. A restructuring was necessary in order to make the legal framework even more transparent and easier to understand for our bexio customers. With the new GTCs and Privacy Policy, we have taken into account the developments of recent years and have also mapped out the legal framework for the use of future opportunities and services.

What do the adjustments to the General Terms and Conditions (GTCs) mean for banking?

bexio will not have access to your bank data in the future. What is changing? If you are new to b.Link, we would like to point out that you can also withdraw your authorisation for eBanking and should do so in the event that you cancel.

Furthermore, we will expand our interface monitoring at bexio. This means that in future we will internally evaluate and analyse error messages that we receive from a bank's interface. This optimisation will enable us to support you as a customer even better and to further improve our services.

Does bexio follow the principle of data economy when exchanging data?

Yes, bexio also applies this principle in the context of adapting our General Terms and Conditions (GTCs) and Privacy Policy (PP).

Can my data be passed on by third parties (for example, partner apps, Mobiliar)?

No, our partners are obliged to use your data only in accordance with the applicable General Terms and Conditions (GTCs) and Privacy Policy (PP).

If you use a partner app via our app store, you automatically agree to the GTCs and Privacy Policy of that partner company. This usage then constitutes a contract between you and each partner company, which then also regulates the use of data by the partner company.

Will my data now be newly stored outside Switzerland?

As before, your data will be stored in databases in a Swiss data centre operated by Google. We create end-to-end encrypted backups (TLS) for security reasons, for example, in the event that a data centre in Switzerland or its data has been destroyed by viruses. These encrypted backups can be stored abroad under the same security conditions as in Switzerland. Your data is thus even more secure and better protected against loss.

Is data access by our parent company «die Mobiliar» legal?

In principle, access to the data is based on the principle of consent. In other words, you as a bexio customer give your consent to this delivery of data in accordance with the applicable General Terms and Conditions (GTCs) and Privacy Policy (DSE). Mobiliar is obliged to process all data that it becomes aware of exclusively within the framework of data protection legislation and to comply with data protection security regulations at all times. In addition, Mobiliar is obliged to maintain confidentiality regarding the data it becomes aware of.

How does Mobiliar use my data?

The customer data may be used by Mobiliar for statistical purposes such as customer base matching, market segment analysis or information exchange, as well as to send bexio customers offers and information material about useful products or services. Please also see section 6 in our Privacy Policy (PP) for comparison.

Why is my data being passed on to Mobiliar even though I am not willing to change my current insurance provider?

The exchange of data between us and Mobiliar enables us to continuously improve our products and services. As a matter of principle, Mobiliar has no knowledge of our customers' insurance relationships.

Exceptions to this are analyses (for example, customer base matching) for statistical purposes.

Do third parties (for example, Mobiliar) gain access to my accounting data with this adjustment of the General Terms and Conditions (GTCs) and Privacy Policy (PP)?

No. Third parties, such as Mobiliar, do not have access to your accounting data at any time. Of course, under no circumstances will accounting data or other sensitive data be shared with the Mobiliar Group.

Exceptions to this are cases in which you have explicitly agreed to data being passed on. One such case is usage of the Smart Insurance app from our app store.

I would like to continue using bexio, but I do not agree with the new conditions of the General Terms and Conditions (GTC) and Privacy Policy (DSE) — What options do I have as a bexio customer?

In order to continue using bexio, agreeing to our new General Terms and Conditions (GTCs) and Privacy Policy (PP) is a prerequisite. If, as a bexio customer, you do not agree with the adjustments, you can cancel your bexio account up to and including 01/06/2022 – but we would very much regret that.

The new conditions do not meet my expectations and I would like to cancel my account. What happens to the payments I have already made to bexio?

What happens if I close my account as of 31.05.2022?

The contract will be terminated as of 31.05.2022 and we will pay you the credit based on the remaining term. You will then have until the end of June (30.06.2022) to migrate or download the data. After that, your data will be deleted and will no longer be available as of 01.07.2022.
